DMCA Policy

This page explains FMG Universe’s policy under the U.S. Digital Millennium Copyright Act (17 U.S.C. §512), including how to send a valid takedown notice and how to submit a counter‑notification.

Overview

FMG Universe (“FMG,” “we,” “us,” or “our”) respects intellectual property rights and expects users to do the same. We comply with the Digital Millennium Copyright Act (“DMCA”). If you believe content available through FMG services infringes your copyright, you can submit a valid DMCA notice and we will respond consistent with §512 of the U.S. Copyright Act.

How to Send a DMCA Notice

To be effective under 17 U.S.C. §512(c)(3), your notice must include all of the following:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list).
  3. Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate the material (e.g., precise URLs, account/profile name, timestamps).
  4. Your contact information (full name, address, telephone, and email).
  5. A statement that you have a good‑faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Submitting incomplete notices may delay processing. We may share your notice—including your contact information—with the user who posted the material.

How to Send a Counter‑Notice

If you believe your material was removed or disabled by mistake or misidentification, you may submit a counter‑notification that includes all items required by 17 U.S.C. §512(g)(3):

  1. Your physical or electronic signature.
  2. Identification of the material removed or to which access has been disabled, and its location before removal.
  3. Your name, address, telephone number, and email address.
  4. A statement under penalty of perjury that you have a good‑faith belief the material was removed or disabled as a result of mistake or misidentification.
  5. Your consent to the jurisdiction of the Federal District Court for your address (or where FMG is located if you reside outside the U.S.), and that you will accept service of process from the original complainant.

Upon receipt of a valid counter‑notification, we may restore the material within 10–14 business days unless the complainant notifies us that they have filed an action seeking a court order to restrain the user from engaging in infringing activity.

Repeat Infringer Policy

In appropriate circumstances, and at our discretion, FMG may terminate, suspend, or limit accounts of users who are determined to be repeat infringers. We also may remove content at any time for any reason consistent with our Terms of Use.

Standard Technical Measures

FMG accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as defined by 17 U.S.C. §512(i).

Third‑Party Platforms & Links

Some FMG experiences may embed or link to third‑party platforms (e.g., YouTube, TikTok, Instagram, Spotify). If allegedly infringing content is hosted by a third party, you should send your notice to that service’s designated agent. FMG cannot remove content hosted on services we do not control.

Misuse, Fair Use & §512(f)

Submitting knowing and material misrepresentations in a DMCA notice or counter‑notice may expose you to liability for damages under 17 U.S.C. §512(f). Before filing, consider whether the use may be lawful (e.g., fair use, license, public domain). If unsure, consult a lawyer.
